Licensing Act 2003

 

The Licensing Act 2003 came into force on 7th February 2005 and operational from 24th November 2005, bringing together the different licensing processes into a single uniformed regime regulated by local authorities throughout the country.

Previously, applications had to be made to a magistrate’s court for a ‘liquor licence’ and a separate application to a local authority for a ‘public entertainment licence’, with the process then having to be repeated periodically to renew the licences.

Under the Licensing Act 2003 there are, in the main, two different types of licence, a premises licence and a personal licence. A premises licence lasts indefinitely or until such time as it is either revoked, surrendered, transferred or expires following any time limited period that may have been applied at the application stage. A personal licence lasts for 10 years or unless it is either revoked or surrendered.

The new Act also places a duty on everyone concerned with licensing to have regard to the four Licensing Objectives. This applies to applicants, local authorities and responsible authorities. The four Licensing Objectives are: -

 

• The Prevention of Crime & Disorder;
• Public Safety;
• The Prevention of Public Nuisance;
• The Protection of Children from Harm.

The Licensing Act 2003 also covers arrangements to appoint a ‘Designated Premises Supervisor’ (DPS), The Provision of Late Night Refreshment, Temporary Event Notices (TEN’s) and Club Premises Certificates.
